Terms of Use of the Online Store www.mygigi.shop

My GiGi Ltd., REGISTRATION NO. 40203581829, ADDRESS: Ropažu iela 14b-12, Riga, LV-1039, hereinafter referred to as the online store, provides the content available on the website and offers goods/services in accordance with the Terms of Use outlined below.

1. General Terms

If a consumer purchases goods/services through the website, such a mutual agreement is considered a Distance Contract and is subject to the legal norms of the Republic of Latvia regulating distance contracts, including but not limited to the Republic of Latvia’s Consumer Rights Protection Law, the Cabinet of Ministers Regulations “Regulations on Distance Contracts”, and others.

2. Making Purchases

The prices and specifications of the products sold in the online store are indicated next to the products.

To place an order, add the desired products to the shopping cart. Fill in all required fields and choose the most suitable delivery method. The total cost of the order with delivery will then be displayed on the screen. Make the payment to complete the order.

3. Payment Terms

The settlement currency on the site is euros. Purchases can be paid using the following payment methods provided by the payment platform makecommerce.lv, Maksekeskus AS:

Latvian internet bank payments: Swedbank, SEB, Citadele, and Luminor

Estonian internet bank payments: Swedbank, SEB, Luminor

Lithuanian internet bank payments: Swedbank, SEB, and Luminor

NB! When using the internet bank payment method, confirm the order and click on the “Return to merchant” button.

Personal data required for making payments is transferred to the licensed payment institution Maksekeskus AS.

The contract comes into effect upon successful payment to the online store’s bank account. If, for some reason, it is not possible to fulfill the order, the Buyer will be informed, and the paid amount will be refunded as soon as possible, but no later than within 14 days after receiving the notification.

4. Delivery Terms

Goods are delivered within the territory of Latvia.

All fees and taxes payable to receive the shipment at the delivery destination must be covered by the Buyer. Delivery costs are displayed before order confirmation. Purchased goods are delivered to the address specified by the Buyer or in the manner chosen by the buyer (e.g., parcel machines).

Delivery is made within 5 working days. In exceptional cases, we have the right to send goods within 45 calendar days, informing the customer accordingly.

5. Right of Withdrawal

The Buyer has the right to withdraw from the product within 14 calendar days from the moment of receiving the product. The right of withdrawal does not apply if the Buyer is a legal entity.

To exercise the 14-day right of withdrawal, the products may only be used for their intended purposes; the consumer is responsible for maintaining the quality and safety of the product during the withdrawal period. If the products are inappropriately used or damaged, handled carelessly during use, or instructions are not followed, if the original packaging is lost or significantly damaged, the online store has the right to reduce the refundable amount according to the decrease in the product’s value.

To exercise the right of withdrawal, you must submit a withdrawal form, which can be found here, sending it to the email address gigi@mygigi.shop within 14 days after receiving the goods.

The Buyer covers the cost of returning the product, except in cases where the reason for the return is that the product does not correspond to the order (e.g., wrong or damaged product).

The Buyer is obliged, without delay but no later than within 14 days after sending the withdrawal form to the online store, to return the products to the Seller. After receiving the returned products, the online store immediately, but no later than within 14 days, refunds all payments received from the buyer based on the Distance Contract.

The Seller has the right to withhold payment until it has received the products from the Buyer or proof of return of the products. If the buyer has chosen a delivery method other than the cheapest delivery method offered by the online store, the online store is not obliged to reimburse the excess delivery costs.

The online store is not responsible for delays in fulfilling obligations or their non-fulfillment caused by circumstances and obstacles beyond the reasonable control of the online store.

The online store reserves the right to refuse to sell goods and demand the return of goods from the Buyer if the price indicated in the online store is significantly lower than its market price due to an error.

6. Consumer Rights Regarding Non-Conforming Goods

The online store is responsible for any non-conformity of the goods sold to the Buyer with the terms of the contract or defects that have arisen within 6 months from the date of delivery of the goods to the customer, or which existed at the time of delivery, if such an assumption does not contradict the nature of the item or defect. The Buyer must inform the Seller of the non-conformity of the goods immediately, within 2 months after its discovery, i.e., submit a complaint. The Buyer can submit a complaint by contacting the online store, writing to gigi@mygigi.shop.

The online store is not responsible for defects that have arisen after the delivery of the goods to the Buyer. If the purchased goods have defects for which the Seller is responsible, the Buyer has the right to request that the defects of the goods be rectified or the goods be replaced with new goods free of charge.

If it is not possible to repair or replace the goods, the Seller returns to the Buyer all payments provided for in the Distance Contract. The Seller provides a written response to the consumer’s complaint within 15 days.

7. Processing of Buyer’s Personal Data

The online store processes only those personal data that the buyer has entered when ordering goods, such as name, surname, email, etc.

The online store transfers personal data to the transport service provider(s) to ensure the delivery of goods.

If you have explicitly agreed to receive our marketing communications, including news, we may from time to time contact you by sending information about our services and latest offers. For this purpose, we may process your email address, which you provided when signing up for marketing communications. The Buyer has the opportunity to opt out of marketing communications by notifying us in writing at gigi@mygigi.shop.

8. Procedure for Dispute Resolution

In matters not specified in these terms and conditions, the Buyer and the Seller undertake to comply with the laws and regulations in force in the Republic of Latvia.

The parties resolve all disputes arising between the Seller and the Buyer through mutual negotiations or correspondence. If the dispute cannot be resolved through negotiations or correspondence, the parties will resolve the dispute in the court of the Republic of Latvia, in accordance with Latvian laws. Disputes between the Buyer (consumer) and the Seller may be submitted for resolution to the Consumer Rights Protection Centre or the court of the Republic of Latvia.

The Buyer also has the right to turn to European Union dispute resolution institutions.
